Is A Separation Agreement The Same As A Divorce Settlement?

A separation agreement covers the same territory that a divorce settlement does, including child custody and support, division of property, financial matters, spousal maintenance, and other relevant issues. In that sense, they are the same, but a separation agreement alone does not make you legally divorced.

A separation agreement can become a divorce settlement. If you have been legally separated for a year and your separation agreement has been satisfactory to you, you may ask the court for what is known as a Conversion Divorce, essentially converting the separation agreement to a divorce settlement.

Many couples choose legal separation rather than rush into a divorce, and later feel confident in their choice to live apart.

The attorneys at Zelenitz, Shapiro & D’Agostino can help you develop separation agreements that give you space to consider your options, and to convert a separation agreement into a divorce settlement if you decide that’s the right choice for you.
